State Street Clay Terms of Service

 

STATE STREET CLAY Terms of Service Effective Date: July 19, 2026

  1. ACCEPTANCE OF TERMS

By accessing or using www.statestreetclay.com, or by attending any class, event, or studio session, you agree to be bound by these Terms of Service. These Terms apply to all website visitors, registered students, event attendees, and retail customers. If you do not agree to these Terms, please do not use our website or services.

State Street Clay reserves the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.

  1. ABOUT STATE STREET CLAY

State Street Clay is a doing-business-as (DBA) name of The Studio at Marblehead Stable LLC. We operate as a pottery and ceramics studio offering classes, workshops, open studio sessions, private events, and retail products. Our services are available to adults and to minors accompanied by a parent or legal guardian, as described in Section 10.

  1. USE OF THE WEBSITE

Our website is provided for lawful, personal, non-commercial use only. You agree not to:

  • Attempt to gain unauthorized access to any part of the website or its systems
  • Introduce viruses, malware, or other harmful code
  • Disrupt or interfere with the functionality of the website
  • Scrape, reproduce, or distribute any website content without our express written permission

State Street Clay reserves the right to suspend or terminate access to the website for any user who violates these Terms.

  1. CLASS AND WORKSHOP REGISTRATION

  • Registration is required for all scheduled classes and workshops
  • Your registration is confirmed only upon receipt of full payment
  • Class sizes are limited; spots are not reserved without payment
  • State Street Clay reserves the right to cancel, reschedule, or modify any class due to low enrollment, instructor availability, or other circumstances beyond our control
  • In the event of a cancellation initiated by State Street Clay, registered participants will receive a full refund or studio credit at their choice

  1. PAYMENT TERMS

  • All fees are due at the time of registration unless otherwise stated
  • Accepted payment methods include credit/debit cards and other electronic payment options as listed on the website
  • All prices are listed in U.S. dollars and are subject to change without notice
  • Applicable sales tax will be added where required by law

  1. CANCELLATION AND REFUND POLICY

  • Cancellations made 72 hours or more before a scheduled class will receive a full refund or studio credit
  • Cancellations made less than 72 hours before a class will receive studio credit only — no cash refunds will be issued
  • No-shows forfeit the registration fee entirely
  • Private events and parties may be subject to separate deposit and cancellation terms, which will be confirmed at the time of booking
  • Studio credits do not expire and are non-transferable
  • State Street Clay reserves the right to make exceptions to this policy at its sole discretion

  1. STUDIO POLICIES AND CODE OF CONDUCT

All students and visitors are expected to follow posted studio rules and instructor directions at all times. Specifically:

  • Closed-toe shoes are strongly recommended in the studio
  • Food and beverages are restricted to designated areas
  • Personal property brought into the studio is at the owner's risk; State Street Clay is not responsible for lost, stolen, or damaged personal items
  • Unauthorized filming, photography, or recording of other students or staff is not permitted without their express consent
  • State Street Clay reserves the right to remove any person who is disruptive, disrespectful, or poses a safety risk, without refund

  1. FIRING AND CLAY SERVICES

Pottery and ceramics involve unpredictable outcomes during the firing process. Please note the following:

  • State Street Clay uses reasonable care in firing and handling all student work; however, we are not responsible for pieces that crack, break, or are otherwise damaged during firing, as this is an inherent risk of the ceramics medium
  • Completed work will be available for pickup and students will be notified when their pieces are ready
  • Work not picked up within 30 days of notification may be discarded at the studio's discretion
  • State Street Clay is not liable for work damaged, lost, or improperly stored due to a student's failure to follow studio guidelines or pick up work within the specified timeframe

  1. INTELLECTUAL PROPERTY

All content on www.statestreetclay.com — including but not limited to text, images, logos, graphics, and course materials — is the property of The Studio at Marblehead Stable LLC or its licensed content providers and is protected by applicable copyright and intellectual property laws.

You may not copy, reproduce, distribute, display, or create derivative works from any site content without our express written permission.

By submitting photos or other content to State Street Clay (for example, via social media tags or email), you grant State Street Clay a non-exclusive, royalty-free license to use that content for marketing and promotional purposes.

  1. MINORS

  • Children under the age of 16 must be accompanied by a parent or legal guardian during all classes, workshops, and studio sessions, unless enrolled in a designated youth program
  • By registering a minor for any program, the parent or legal guardian agrees to these Terms on behalf of the minor
  • State Street Clay is not responsible for unsupervised minors on the premises

  1. WAIVER OF LIABILITY AND ASSUMPTION OF RISK

Pottery and ceramics involve inherent physical risks, including but not limited to:

  • Exposure to clay dust and ceramic materials
  • Use of sharp tools and equipment
  • Hot kilns and high-temperature surfaces
  • Wet and slippery studio surfaces

By participating in any class, workshop, open studio session, or other studio activity, you voluntarily acknowledge and assume all such risks. You agree to release, waive, and discharge The Studio at Marblehead Stable LLC, its owners, employees, instructors, and agents from any and all claims, demands, or causes of action arising out of or related to your participation in studio activities, to the fullest extent permitted by applicable law.

This waiver does not limit liability for gross negligence or intentional misconduct.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, State Street Clay and The Studio at Marblehead Stable LLC shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind arising from your use of the website or participation in any studio services.

In no event shall our total liability to you for any claim exceed the amount you paid for the specific class, product, or service giving rise to the claim.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless State Street Clay and The Studio at Marblehead Stable LLC, including its owners, employees, instructors, and agents, from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your misuse of the website or studio facilities
  • Any content you submit to State Street Clay

  1. PRIVACY

Your use of our website and services is also governed by our Privacy Policy, available at www.statestreetclay.com/privacy-policy. By using our services, you consent to the data collection and use practices described in the Privacy Policy.

  1. SMS COMMUNICATIONS

By opting in to SMS communications from State Street Clay, you agree to receive text messages as described in our Privacy Policy. You may opt out at any time by replying STOP to any message. Message and data rates may apply. Consent to receive SMS messages is not a condition of purchase.

  1. THIRD-PARTY LINKS AND SERVICES

Our website may contain links to third-party websites or integrate third-party service providers such as payment processors. State Street Clay is not responsible for the content, privacy practices, or policies of any third-party sites or services. Your use of third-party services is at your own risk, and we encourage you to review their terms and policies independently.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the use of our website or services shall be resolved exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction in those courts.

Before pursuing formal legal action, both parties agree to attempt resolution in good faith by contacting rachel@statestreetclay.com.

  1. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

  1. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and State Street Clay with respect to your use of the website and our services. They supersede all prior communications, agreements, or understandings, whether written or oral, relating to the same subject matter.
